Bizzphlo Terms of Service

These terms apply to the use of Bizzphlo, business software operated by House of Bhram, Mumbai, India (“House of Bhram”, “we”, “us”). By using Bizzphlo, the business that has been given access (the “Customer”, “you”) agrees to them.
Where you have a signed agreement or proposal with House of Bhram for Bizzphlo, that document applies alongside these terms, and it takes priority if the two conflict.
1. The service
Bizzphlo provides tools for managing customers, deals, tasks, follow-ups, automations and WhatsApp communication, together with any industry module enabled for you. Bizzphlo is set up for each Customer by House of Bhram. It is not a self-service product, and features may differ between Customers.
2. Business use and accounts
- Bizzphlo is for business use by you and the staff you authorise.
- You are responsible for your users, for keeping sign-in details confidential, and for activity under your accounts.
- Tell us promptly if you suspect an account has been accessed without permission.
- Users must be adults.
3. Your data
You keep ownership of the data you and your users put into Bizzphlo. You give us permission to process it only to provide, support and secure the service.
You are responsible for the accuracy and lawfulness of that data, including having a lawful basis, and consent where required, for holding your customers’ personal information. Our handling of data is described in the Bizzphlo privacy policy.
4. WhatsApp messaging
WhatsApp features depend on the WhatsApp Business Platform provided by Meta, and are available only once your business number has been approved by Meta. When you use them:
- you must comply with Meta’s and WhatsApp’s terms and policies for business messaging;
- you are responsible for obtaining and recording your customers’ consent (opt-in) before messaging them, and for honouring opt-outs promptly;
- you are responsible for the content of the messages you send, including automated ones.
5. Acceptable use
You must not use Bizzphlo to:
- send spam, unsolicited bulk messages, or messages to people who have not agreed to receive them;
- send unlawful, misleading, abusive or harassing content;
- break any law that applies to you or to your customers;
- attempt to gain unauthorised access to Bizzphlo, to other Customers’ data, or to the systems it runs on;
- copy, resell or reverse-engineer the software.
6. Intellectual property
Bizzphlo, including its software, design and name, belongs to House of Bhram. We keep all rights in it, including in our pre-existing and reusable components, frameworks and know-how. You receive a right to use Bizzphlo for your own business for as long as your access continues. You do not receive ownership of the software.
7. Availability, maintenance and support
We work to keep Bizzphlo available and reliable, but we do not promise uninterrupted or error-free service. The service may be unavailable during maintenance, which we try to schedule at quiet times, or because of problems outside our control. Support is provided through the contact method agreed with you.
8. Third-party platforms
Bizzphlo relies on services provided by others, including Meta’s WhatsApp Business Platform and hosting providers. Those services have their own terms, may change, and may be interrupted or withdrawn. We are not responsible for the acts or failures of third-party platforms, although we will make reasonable efforts to help you work around them.
9. Suspension
We may suspend access, in whole or in part, if we reasonably believe that Bizzphlo is being used for spam or unlawful purposes, that an account has been compromised, that continued use puts the service or other Customers at risk, or that fees are overdue under your agreement. Where practical we will tell you first and give you a chance to fix the problem.
10. Fees
Fees and payment terms for Bizzphlo are set out in your proposal or agreement with House of Bhram.
11. Liability
To the extent permitted by law:
- Bizzphlo is provided as a business tool. You remain responsible for your business decisions, your legal compliance and your use of your customers’ data.
- We are not liable for indirect or consequential loss, including loss of profit, revenue or business opportunity.
- Our total liability relating to Bizzphlo is limited to the fees you paid us for Bizzphlo in the twelve months before the claim arose.
Nothing in these terms excludes liability that cannot be excluded by law.
12. Ending the service and your data
Either party may end the service as set out in your agreement. When the service ends, you may ask for an export of your data. After that, your data is deleted from the live system as described on the data deletion page, subject to the limited retention explained there.
13. Changes
We may update these terms as the product develops. The date at the top shows the latest version. We will tell Customers about significant changes. Continuing to use Bizzphlo after a change means you accept the updated terms.
14. Governing law
These terms are governed by the laws of India.
